The Executive Action offers Venezuelan exiles protection from deportation as one of the last executive actions

Abogada Nancy Reyes Guarderas of the Matian Firm | La Liga Defensora is scheduled to appear on California radio and TV stations to discuss the former president’s use of a little-known Deferred Enforced Departure (DED) program to offer temporary legal status to Venezuelans fleeing the humanitarian crisis brought on by Venezuelan President Nicolás Maduro.

DED is a similar program to Temporary Protected Status (TPS) where recipients are protected from deportation and can obtain work permits. Unlike TPS, DED is granted directly by the president instead of the Department of Homeland Security.

The new policy defers deportation to “any national of Venezuela, or alien without nationality who last habitually resided in Venezuela, who is present in the United States as of January 20, 2021.”

Guarderas said, “Venezuelans have suffered for a long time and this is one of Latin America’s greatest humanitarian crises in many years. I’m glad the U.S. is ready to help this vulnerable group of immigrants.”

Those not protected under the program include:

  • Venezuelans who have voluntarily returned to Venezuela or their country of last habitual residence outside of the U.S.

  • Venezuelans who have not continuously lived in the U.S.

  • Venezuelans who have been convicted of a felony or two or more misdemeanors 

  • Venezuelans who are subject to extradition

The policy will offer 18 months of deportation protection for qualified Venezuelan nationals currently in the United States.
